Costa Rica News – Deputies have revived prison sentences for sexual abuse against adults, something that was not being enforced due to complications with the Penal Code.
With today’s reform, two to four years in prison will again be imposed.
This applies to cases involving only adults and not constituting rape. It took almost eight years for the Legislative Assembly to amend the error that was introduced in the Penal Code in 2010 which led to inapplicability of sentences.
The issue seems to be that as it was worded, the law required way too much interpretation for applying the sentences as well as generated problems in labeling the criminal type.
The amendment made is a reform of Article 162 of the Criminal Code. There is no longer any uncertainty in the law and it will be enforced.
