The Contentious Administrative Court took a decision on January 13th, in favor of Mauricio Azofeifa, owner of the chiliguaro trademark. The National Liquor Factory violated the right of the brand.
This was done by listing the ingredients chili and guaro in larger letters than the rest of the ingredients on the label, creating a confusion with the Chiliguaro brand. This violated the Law on Trademarks and Other Distinctive Signs.
The product was launched in 2017 under the Cacique brand. It was pointed out that the main ingredients are striking and occupy an important space on the commercial label.
The National Liquor Factory has been notified about the resolution and will comply with the sentence. The internal Legal Department of the institution is analyzing this.
The compensation is less than one million colones, for moral damage. The brand owner did not seek to become rich rather defend the name of his product, which was registered in 2013.
