I will not even go into the fact that these new laws are just going to cause more corrupt cops and solicitiing of bribes. I am not going to go into the fact that all the cops that have been caught taking bribes were given paid leave….in other words paid vacation. I am just going to address the topic at hand. These entities have had over two months to prepare for the launch of this law. No with is a day away they act like they are surprised that they need to be ready for the change…… ignorance is not an excuse for anything.
According to a press release from MOPT, Friday, the same day that the law is put into place “they will begin to calibrate breathalyzers and it is estimated that next Wednesday will be able to use the equipment in the field” .
Meanwhile, breath tests will be conducted with older breathalyzers, “calibrated based on current law to date and the results of the test will be converted according to a table which is authorized and developed by the College of Microbiologists of Costa Rica” .
Ok this is just retarded, are they saying that it will not read past a certain amount? Breathalyzers are just supposed to make a reading and then they can judge if it is over or under the legal limit. Even if it was not calibrated the only thing that changed was the law.
Furthermore, Ileana Herrera, director of Health, confirmed that the Ministry of Health will not have the list of approved laboratories in public and private medical centers to perform blood tests for drunk drivers.
According to the Act, the “official list of centers approved by the Ministry of Health” must be delivered to the Transit Police and Cosevi.
This blood test is essential to be able to present to the judge to drivers who violate alcohol limits, those exposed to a jail term of one to three years.
Herrera acknowledged that until last Monday warned them of the urgency of the list and would not say when it would be finished.
But, said his task “is not so simple” because laboratories performing specific blood test that should be recognized by the Costa Rican Accreditation Entity (ECA), under the Ministry of Science and Technology (Micit).
Silvia Bolaños, the Cosevi, made no reference to this list, although it is a requirement in the law-rather argued that any hospital may refuse to perform the test when the driver arrives accompanied by transit officer.
